Staff Announcements:

Lisa Medina – Environmental Management Agency Director – IT implemented a new software program. When you visit our sites, you will find important pop up information on the websites. Currently have 80 cats and kittens, in need of foster care. Air pollution – you can click on link that shows the current air quality in Calaveras County. Thank you to IT staff to help us serve our community better.

Recognition and Acknowledgments

2. Proclamation – Clerk of the Board of Supervisors (ID # 7412) Adopt a Proclamation honoring Mary Anne Garamendi for her distinguished service in Mokelumne Hill and Calaveras County.

• Supervisor Garamendi read the proclamation (his Aunt).
Motion to approve proclamation – Passed – 5 – 0.

Consent Agenda

3. Agreement – Administrative Office (ID # 7434) Authorize the Board Chair to execute an Agreement for Conflict Public Defender Services between the County and David K. Singer for FY 2023-24 and FY 2024-25 for an amount not to exceed seven thousand five hundred dollars ($7,500) per month.

4. Agreement – Administrative Office (ID # 7439) Authorize the Board Chair to execute an Agreement with Diebold Funeral Holdings, Inc to provide mortuary services for the period of July 1, 2023 through June 30, 2027 in the amount not to exceed $670,000.00.

5. Agreement – Behavioral Health (ID # 7418) Authorize the Board Chair to sign an Agreement with Mental Health Management I, Inc., doing business as Canyon Manor in an amount not to exceed $400,000 for the period of July 1, 2023, through June 30, 2024, to be utilized on an as-needed basis.

6. Agreement – Behavioral Health (ID # 7419) Authorize the Board Chair to sign an Agreement with JDT Consultants, Inc. for the provision of therapeutic behavioral services for a not to exceed amount of $890,000 for the period July 1, 2023 – June 30, 2024.

7. Agreement – Behavioral Health (ID # 7420) Authorize the Board Chair to execute an Agreement with Oakendell, Inc., for the provision of specialty mental health services in an amount not to exceed $500,000 over the period of July 1, 2023, through June 30, 2024, to be utilized on an as-needed basis.

8. Agreement – Health and Human Services Agency (ID # 7352) 1. Make a public benefit finding and approve a below-market lease of Huberty Building to the Calaveras Chamber of Commerce; and 2. Authorize the Board Chair to enter into the aforementioned lease for the period of July 1, 2023, through June 30, 2028.

9. Agreement – Health and Human Services Agency (ID # 7358) Authorize the Board Chair to execute the sublease Agreement with Central Sierra Child Support Agency for office space located at 509 E. St. Charles in San Andreas, resulting in revenue of up to $11,436 for the period July 1, 2023 through June 30, 2025.

10. Resolution – Human Resources (ID # 7447) Adopt a resolution authorizing a correction to the position control list for FY 2023-24.

11. Action Item – Integrated Waste Management (ID # 7409) Authorize the Purchasing Agent to issue a Blanket Purchase Order for Hunt and Sons in an amount not to exceed $180,500 for the fiscal year 2023-24.

12. Agreement – Probation (ID # 7416) Approve, and authorize the purchasing agent to sign, the agreement between Calaveras County and Yuba County for the use of Yuba-Sutter-Colusa Tri-County Regional Juvenile Rehabilitation Facility, Maxine Singer Youth Guidance Center with a term ending June 30, 2026, and total not-to-exceed amount of $50,000 per fiscal year.

13. Agreement – Probation (ID # 7417) Approve and Authorize the Board Chair to sign amendment #4 to the original MOU dated September 26, 2017, between Calaveras County and Tuolumne County for the use of the Mother Lode Regional Juvenile Detention Facility for the period July 1, 2023 through June 30, 2025.

14. Action Item – Public Works (ID # 7422) Direct the County Purchasing Agent to issue Blanket Purchase Orders for McCoy Tire Service in an amount not to exceed $55,000; Foothill Materials in an amount not to exceed $50,000; Eastburn, LLC in an amount not to exceed $70,000; Martin Marietta Material, Inc. in an amount not to exceed $125,000; Valley Pacific Petroleum in an amount not to exceed $150,000; HOLT of California in an amount not to exceed $225,000; Hunt and Sons in an amount not to exceed $300,000; and George Reed, Inc. in an amount not to exceed $500,000 for the period of July 1, 2023 through June 30, 2024.

15. Action Item – Public Works (ID # 7431) Approve the Final Map for Tuscany Hills, Phase II, Subdivision (TSTM 2001-154) in Copperopolis.

Supervisor Huberty recused himself from voting on item #8.
Motion to approve consent items 3 – 16 – passed 5 – 0.

Regular Agenda

16. Action Item – Clerk of the Board of Supervisors (ID # 7438) Appoint members of the Calaveras County Resource Conservation District.

Supervisor Stopper – I would suggest making John Osborne Ag Industry Rep and Sarah Hodson being the alternative.
Motion to approve action item – Passed – 5 – 0.

17. Agreement – Human Resources (ID # 7446) Authorize the Board Chair to execute a services contract with Evergreen Solutions, LLC in an amount not to exceed $54,500, to generate a Classification and Compensation study.

• Judy Hawkins – Human Resources and Risk Management Director – want a comprehensive study. Put out RFP and only had one response and it was too much. Reached out to colleagues for recommendations. Spoke with Evergreen and their references were good. They are currently working with Mariposa. Feel they can complete the process in about six months.
Motion to approve action item – Passed – 5 – 0.

18. Ordinance – Planning (ID # 7407) Conduct a public hearing, authorize a Notice of Exemption from CEQA, and adopt an ordinance amending the zoning of a 0.98-acre portion of APN: 010- 029-002 from General Forest (GF) to General Agriculture (A1) for Angelia Ramage; authorize summary publication and a brief property description and map of the reclassified property.

Motion to approve action item – Passed – 5 – 0.

19. Action Item – Building (ID # 7296) 1) Find Exempt from CEQA; 2) Introduce and waive the first reading of an Ordinance amending Chapter 3.53 – “Building Department Service Fees” of the Calaveras County Code; 3) Conduct a public hearing, and 4) Authorize a summary publication of the Ordinance.

• Doug Oliver – Power point presentation presented. Please review notes and video for detailed  information.
• Why Update Fees: Ensure proper cost recovery. Ensure fee allocation is relative to the services provided. Adapt to changes in workload relative to new laws and codes. Reflect added services. Demonstrate transparency about the services provided in exchange for the fees that are collected.
Motion to approve action item with amendment for school fire inspection to be waived – Passed – 5 – 0.

Supervisor Announcements

• Supervisor Stopper – will reserve for next meeting any reporting out but would like all BOS to
denounce any hate speech/action. Chair Tofanelli – thinks County Counsel should bring
something back at future BOS meeting. Sarah Edwards – County Counsel – will bring back
at next meeting.
• Supervisor Huberty – thank you for bringing up the hate speech, we have been targets of that in our districts. Attended as an alternate the Calaveras Power Agency Meeting on July 19, attended Central Sierra Support Meeting yesterday, reminder August is Child Support Awareness month, attended homecoming in the park in Murphys, went to opening of Bear Valley Music Festival and Hank Williams concert at Ironstone. It is amazing we have this talent in our county.
• Supervisor Garamendi – agree re bringing statement re hate speech. Golden State Connect Authority will present to this board in August, big initiative state wide.
• Supervisor Folendorf – Annual Dinner on August 20 at Bryce Station and we are all invited.
